Terms & Conditions

By working with Eagle Eye Property Shots, LLC, you agree to the following Terms & Conditions: 

Property Preparation:

  • Please ensure the property is fully prepared for photography before the scheduled arrival time. This includes cleaning, organizing, and arranging furniture appropriately.

  • We recommend that homeowners and agents review our Getting Ready Guide in advance.

  • If the photographer arrives and the property is not ready, it will be photographed in its current condition.

  • Your input is important in capturing the best features of the home. If you'd like to share preferences, please meet the photographer at the start of the session or leave detailed notes in the comments section of your booking.

  • If there are no preferences, the photographer will rely on their professional judgment to select the most appropriate angles and compositions.

Order Information & Accuracy:

  • It is the client's responsibility to provide complete and accurate details when placing an order. If any discrepancies are found (e.g., a property listed as 2,500 square feet is actually 3,200 square feet), we have the right to update the information and adjust the pricing accordingly.

  • If clubhouse/amenity photos and/or videos are not available in our existing library, we can include complimentary amenity photography as part of your photo package, upon request. Prior authorization from property management is required before proceeding. All amenity photos will be added to our image library and may be shared with other clients or real estate professionals at no cost.

Rescheduling & Cancellation Guidelines:

  • Appointments that are canceled or rescheduled less than 24 hours before the scheduled start time may incur a $50 fee.

  • If an appointment cannot proceed due to weather conditions, such as strong winds or heavy rain that prevent drone use or exterior photography, we will contact the agent to reschedule, and the cancellation fee will not apply.

Billing & Payment Policy:

  • Invoices are issued once all media has been delivered, and payment is expected upon receipt.

  • A $25 monthly late fee may be applied to any unpaid balances after 15 days.

  • Accounts with balances outstanding for more than 45 days may be temporarily suspended, including access to media and the ability to place new orders, until payment is received.

  • If an account remains unpaid for 90 days, it may be referred to a collections agency for further action.

Usage Rights & Ownership:

By agreeing to these terms, you grant Eagle Eye Property Shots, LLC and its affiliates, contractors, partners, licensees, successors, and assigns a non-exclusive, perpetual, worldwide license to use, reproduce, display, distribute, and transmit the media content ("Media Content") created as part of this service. This includes, but is not limited to, photos, videos, 3D tours, floor plans, graphics, audio, animations, and any related or derivative content produced.

Eagle Eye Property Shots, LLC retains all ownership and copyright of the media content. Eagle Eye Property Shots, LLC can feature the Media Content on our website or social media platforms for promotional purposes and to showcase our work. The Media Content can also be used by Eagle Eye Property Shots, LLC for portfolio display, marketing, promotional materials, editorial publication, awards submissions, and showcasing within company facilities, or outside of Eagle Eye Property Shots, LLC premises.

Eagle Eye Property Shots, LLC may outsource photos to be edited, and videos to be developed. The Media Content may be sub-licensed, assigned, or distributed to third-party partners at Eagle Eye Property Shots, LLC discretion. You may not sell, license, reproduce, alter, or create derivative works of the Media Content without prior written approval from Eagle Eye Property Shots, LLC.

Clubhouse/Amenity Media Content that received prior authorization from property management, will be stored with Eagle Eye Property Shots, LLC and may be shared by Eagle Eye Property Shots, LLC with other clients or real estate professionals at no cost.

Usage Rights:

In exchange for the Grant of Rights set forth herein, Eagle Eye Property Shots, LLC grants you limited license to use the delivered media content for marketing and promotional purposes. This includes advertising the specific property, promoting your real estate services, listings, brokerage, or related business activities.

This license is non-exclusive, non-transferable, and valid across all regions and media platforms, including your personal or business websites. You may also allow third-party platforms—such as MLS and real estate listing sites—to display the content, but only for the purpose of marketing the specific property while it remains actively listed.

Once the property is no longer on the market or the listing agreement ends, authorization to display the media on third-party sites automatically expires.

Permissions and Responsibility for Clearances:

By hiring Eagle Eye property Shots, LLC to create media content, you confirm that you have the authority to do so on behalf of the property owner and that you have secured all necessary permissions, approvals, and legal clearances (“Clearances”) related to the use of the property and any elements captured in the production. This includes, but is not limited to, permission from the property owner and any individuals or entities with intellectual property rights associated with features on or within the property, including architectural elements.

You also affirm that the property owner and any current residents or occupants have waived any privacy expectations regarding the photography, videography, or other media produced under this agreement.

You agree to fully indemnify and hold harmless Eagle Eye Property Shots, LLC against any claims, legal fees, or other expenses arising from the use of media for which proper Clearances were not obtained by you, or where the use exceeded the scope of permissions granted you.

Indemnification and Liability Release:

In addition to the responsibilities outlined elsewhere in these terms, you agree to defend, indemnify, and hold harmless Eagle Eye Property Shots, LLC—along with its employees, contractors, officers, members, agents, licensees, successors, and assigns—from any claims, damages, losses, liabilities, or expenses (including reasonable legal fees and court costs) that arise out of:

  • Your failure to meet any representations, warranties, or obligations stated in this agreement;

  • Any use, sharing, or distribution of the media content produced under this agreement that violates applicable terms; or

  • Any negligent or intentional acts or omissions by you or by individuals acting on your behalf, including employees, contractors, clients, family members, property owners, or guests.
